Former Guam Del. Mike San Nicolas was charged Monday with driving while impaired and reckless driving after an early morning traffic crash in Tumon.
Police found San Nicolas, 44, at 2:24 a.m. in a Toyota Prius lying on its side on Santos Hill near Gun Beach Road. San Nicolas, the car's only occupant, was able to escape the vehicle by crawling through the driver’s side window.
The former congressman told police he was coming from Shamrocks Sports Pub and Route 66 bar after drinking with friends. According to court documents, San Nicolas said he was distracted by his phone while making a turn, and “the next thing he remembered was that his car was on its side.”
Police said San Nicolas had bloodshot, watery eyes and failed a sobriety test.
He refused to sign the implied consent form, and chose not to speak further or acknowledge his Miranda rights, according to charging documents.
He was taken to Guam Regional Medical City after complaining of back pain.
